Liberalization of the Registration Rules for .PT Domain Names

The Portuguese registry (FCCN) has announced new registration requirements for .PT. Under the new policy, domain names directly under .PT may be registered by all individual or corporate entities following the first-come, first served principle. So far domain names directly under .PT are only available for companies, public and private institutions, registered business persons, independent professionals and trademark owners.

The new .PT registration rules will come into force on March 1, 2012 with a Sunrise period of 60 days. This Sunrise period is the last opportunity for above mentioned entities to register their name / trademark as a .PT web address before the registration of .PT domain names will be opened to the general public.

During the Sunrise period, further rights will be accepted. These may be registered in Portugal or abroad. The registry will accept all fully constituted rights; applications for registration of rights will not be accepted. FCCN will request proof where necessary, which must be provided within 48
hours after notification.

The newly accepted rights for individual persons include:
- Sole proprietorship establishment
- Brand (mixed or verbal)
- Name of establishment (mixed or verbal)
- Logo
- Artistic name
- Professional name
etc.

The newly accepted rights for collective entities include:
- Trademarks (mixed or verbal - right doesn't have to be extended to Portugal)
- Name of establishment (mixed or verbal)
- Logo
- Artistic name
- Publication Name (newspapers, magazines)
etc.

In the event of a dispute over a Sunrise domain name, the applicant of a domain name and the .PT registry agree to turn to voluntary institutionalised arbitration (arbitration center: ARBITRARE. The arbitration procedure consists of an extra-judicial mechanism for resolving disputes.

The liberalization of .PT domains will fully apply as of May 1, 2012.
